General Terms and Conditions

1. Scope of Application
These Terms and Conditions apply to contracts for the rental of rooms, seminar rooms, and other event spaces, as well as to services provided by the Foundation »European Youth Education and Youth Exchange Center Weimar« in connection with its educational mission.
The guest’s general terms and conditions shall apply only if this has been expressly agreed to in writing in advance.

2. Conclusion of the Contract
Unless otherwise specified in the respective offers from the EJBW, the contract is concluded upon written confirmation by the EJBW.

3. Services
The scope of services is set forth in the service description and in the details provided in the offer.
Any verbal side agreements that alter the scope or content of the contractually agreed-upon services require express written confirmation.

Organizational or content-related changes that become necessary during the course of the stay or event may be made provided they do not affect the overall structure of the contract or are expressly approved.

For room reservations, bed linens are provided free of charge. Guests must bring their own towels. Towels may be rented for a fee.

4. Prices
The prices for the booked services are based on the price list in effect at the time the contract is entered into, as well as the applicable seminar description.

Individual services that are not utilized do not result in a reduction of the agreed-upon prices.
Buffets, receptions, and similar events are not covered by this provision and must therefore be paid for separately.

All services and goods requested separately by the guest will be billed to the guest separately. Taxes and fees levied by third parties must be paid directly to those third parties by the guest as the liable party.

Cultural Promotion Tax
The City of Weimar levies a cultural promotion tax per night for guests who have reached the age of 18, currently amounting to 2.25 EUR for a double room and 3.00 EUR for a single room. The amount of this cultural promotion tax is subject to change; the EJBW has no influence over this. This tax does not apply if the overnight stay is primarily required for business purposes. The EJBW is obligated to collect this cultural promotion tax and forward it to the City of Weimar.

5. Cancellation by the Guest
Cancellation of the contract is free of charge up to 12 weeks before the booked date.
If cancellation occurs between 12 and 8 weeks before arrival, a cancellation fee of 20% of the agreed-upon total price is due; if cancellation occurs between 8 and 4 weeks before arrival, a cancellation fee of 50% of the agreed-upon total price is due.
For cancellations made less than four weeks before the scheduled date, a cancellation fee of 80% of the contractually agreed-upon total price will be charged. For groups of up to 50 people, one person may be canceled free of charge on a one-time basis; for groups of 50 or more people, two people may be canceled free of charge on a one-time basis.

6. Cancellation by the EJBW
If, for a compelling reason beyond its control, the EJBW is unable to provide the contractually agreed-upon service, or if there is a risk that such inability will occur at the time of service, the EJBW is entitled to withdraw from the contract without giving rise to a claim for damages.
Such a compelling reason includes, for example, force majeure, severe weather, strikes, fire, or similar events.

A right of withdrawal exercisable at any time exists if there is reason to fear that the occupancy or the event may jeopardize the smooth operation of the business, the safety, or the public reputation of the EJBW.

In the aforementioned cases, there is no entitlement to damages.
In all other respects, the statutory provisions apply.

7. Check-in and Check-out
On the day of arrival, rooms are generally available starting at 3:00 p.m.
If you arrive earlier, or in the rare event that the rooms are not yet ready for occupancy, you may store your luggage separately on the premises; however, we cannot accept liability for any loss or damage.

On the day of departure, rooms must be vacated by 9:00 a.m. and the keys returned. After the keys are returned, a final inspection of the rooms will be conducted with the guest(s) or supervisor(s). Please allow sufficient time for this, depending on the number of participants.

If an early departure is planned, sufficient time must also be scheduled for a proper inspection of the rooms.

8. Liability
During participation in seminars and programs—including trips and excursions offered and organized by the EJBW—as well as during the stay on its premises and grounds, liability for damages suffered by the guest is limited to cases of willful misconduct and gross negligence. Any further liability is excluded.

The EJBW assumes no liability for the loss, damage, or theft of personal belongings brought by the guest.

The guest is liable to the EJBW for damages and consequential damages caused by the guest, their employees, speakers, participants, or contractors.

Damage to EJBW property or to items that do not belong to the guest must be reported to the front desk immediately upon discovery.

The loss of a key or rendering it unusable will be billed at a rate of 60.00 EUR per (room) key.

A flat fee of 80.00 EUR per room will be charged for increased cleaning costs resulting from excessive soiling. This flat fee does not apply if it can be proven that greater effort is required and this results in higher costs.

Beds must be fully made up using the bedding provided. If this is not done, the EJBW will charge a cleaning fee of 50 EUR.

Smoking is prohibited in all rooms and on the entire EJBW premises. Smoking in a room will result in a penalty fee of 200 EUR. The same applies to tampering with smoke and warning alarm systems.

Items left behind by guests will be stored by the EJBW for a period of 3 months. Guests may pick up these items within this period or arrange for them to be forwarded. In such cases, the guest must bear the costs as well as the risk of loss of the item during shipping.

9. Fire Safety
The use of open flames (especially candles, tea lights, and sparklers) is prohibited. The same applies to barbecuing on the entire EJBW premises.

10. Permits and Approvals
The guest is responsible for independently obtaining information about and applying for any official permits required for an event. The guest must obtain the necessary permits in a timely manner and at their own expense.

11. Pets
Pets are not permitted on the premises. If needed, we will be happy to refer you to a nearby dog boarding facility.

12. Protection of Minors
The EJBW is an educational institution whose mission is primarily focused on young people.

The EJBW and its entire premises are smoke-free.

The Youth Protection Act applies on the premises and at events, meaning that the consumption of alcohol by minors under the age of 16 is strictly prohibited. For minors between the ages of 16 and 18, the statutory protective regulations apply.

If compliance with the Youth Protection Act cannot be ensured on the part of a young guest, the EJBW reserves the right to impose a complete and general ban on alcohol.
In the event of repeated, significant violations of this rule, the EJBW has the right to terminate the contract without being liable for damages.

13. Data Protection
The EJBW collects, processes, and uses the personal data of registered participants, using service providers where necessary. The data will not be disclosed to third parties.

14. Photographs, Video, and Audio Recordings
The taking and publication of photographs, video, or audio recordings on the EJBW premises are permitted only if
(1) the EJBW has given its prior consent and
(2) the individuals concerned have expressly consented, insofar as their rights to their own image or other personal rights are affected.
The statutory provisions, in particular the General Data Protection Regulation (GDPR) and Sections 22 and 23 of the German Art Copyright Act (KunstUrhG), remain unaffected.
In the event of violations, the EJBW is entitled to take appropriate measures within the scope of its right to manage its premises

15. Conduct on the Premises
Clothing, symbols, or statements that are racist, anti-LGBTQ+, anti-Semitic, inhumane, or anti-constitutional are prohibited on EJBW premises.

In the event of such violations, the EJBW is entitled to take appropriate measures within the scope of its right to manage the premises. This may include—particularly in the case of serious or repeated violations—the exclusion of individuals from the premises or the extraordinary termination of the contract for good cause.

16. Severability Clause
Should any individual provision of these terms and conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
